The company MADAME LA PRESIDENTE is an e-commerce site accessible via the Internet. It is open to any user of this network.
The website accessible at the address “htpps://www.madamelapresidente.fr” allows the company MADAME LA PRESIDENTE to offer for sale hair products and food supplements and accessories to users as well as the subscription to a subscription giving right at the service MADAM PRESIDENT. This service consists of the monthly sale by subscription of hair products, food supplements and accessories.
Governed by articles L.111-1 et seq. of the Consumer Code, these general conditions of sale determine the rights and obligations of the parties. By simply validating their order on the website, the user declares to have read, understood and accepted without reservation the terms of said order as well as the entirety of these general conditions of sale.
It is specified that the products are intended for the user's personal use, without any direct connection with the user's professional activity. As such, the user's attention is particularly drawn to the fact that the amount of their order must not exceed the sum of four hundred euros (€400).
These general conditions of sale apply, without restrictions or reservations, to all sales concluded by the company MADAME LA PRESIDENTE, a simplified joint stock company with capital of five thousand euros (€5,000), whose head office is located 1 shopping center in La Tour 93120 La Courneuve registered in the Paris Trade and Companies Register under number 829 089 086, VAT number FR76 828 089 086 (hereinafter referred to as the “Seller”) to consumers and professional and non-professional buyers (hereinafter, the “Customer” or “Customers”), wishing to acquire the products offered for sale by the Seller via its Site.

The General Terms and Conditions exclusively govern contracts for the online sale of MADAME LA PRESIDENTE products to buyers having the status of Customers (hereinafter the “Customers”) and constitute with the order form the contractual documents enforceable against the parties, to the exclusion of all other documents, prospectuses, catalogs or photographs of the products which have only indicative value. The General Conditions of Sale are exclusively applicable to products delivered to Customers established in the territory defined in Article 5. The General Conditions of Sale are drawn up, as well as all contractual information mentioned on the site, in French.
2.3 Availability and enforceability of the General Terms and Conditions:
The General Terms and Conditions are made available to Customers on the MADAME LA PRESIDENTE website where they can be directly consulted and can also be communicated to Customers upon simple request by telephone, email or postal mail. 2.4 Modification of the General Terms and Conditions:
MADAM THE PRESIDENT reserves the right to modify the General Terms and Conditions at any time. In the event of modification of the General Conditions of Sale, the applicable General Conditions of Sale are those in force on the date of the order, a copy of which dated to date can be provided to the Customer upon request.

2.5 Clauses of the General Conditions of Sale:
The nullity of a contractual clause does not result in the nullity of the General Terms and Conditions unless it is an impulsive and decisive clause having led one of the parties to conclude the sales contract. The sales prices, in accordance with article L. 113-13 of the Consumer Code, are indicated, for each of the products appearing in the electronic catalog, in euros all taxes included, excluding delivery and transport costs mentioned before validation of the order and charged extra. The total amount owed by the Customer is indicated on the order confirmation page. The selling price of the product is that in effect on the day of the order. In the event of a price promotion, MADAME LA PRESIDENTE undertakes to apply the promotional price to any order placed during the duration of the promotion.
4.2 Modification:
MADAME LA PRESIDENT reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in force on the day of the order.

6.2 Steps for concluding the contract:
The Internet Customer can freely add or delete the desired products from his “basket”. At any time, the customer can have access to a detail summarizing the contents of their “basket”. If this summary corresponds to the desired products, the customer freely validates their order on the tab assigned for this purpose. Any order can only be validly registered if the Customer has previously identified himself or if he has duly completed the electronic contact form. The Customer has the possibility to check the details of his order and its total price and to return to previous pages to correct any errors or possibly modify his order. Validation of the order entails acceptance of the General Terms and Conditions and forms the contract. Once the basket has been validated, the customer must accept the General Terms and Conditions of which he is deemed to have previously read, choose the address and delivery method and finally validate the payment method.
In accordance with the provisions of the law of March 13, 2000 no. 2000-230, the final validation of the order constitutes proof of its completeness and renders due the sum incurred by entering the items mentioned on the order form. The validation “click” constitutes an electronic signature within the meaning of article 1316-4 et seq. of the Civil Code, which has the same probative force as a handwritten signature. 6.3 Acceptance of the order:
MADAME LA PRESIDENT reserves the right to refuse any order for legitimate reasons and, more particularly, if the quantities of products ordered are abnormally high for buyers who are Customers.
In certain cases, notably non-payment, incorrect address or any other difficulty of any nature whatsoever, MADAME LA PRESIDENT reserves the right to block the said customer's order until the problem is resolved, or to cancel the order.
6.4 Unavailability of ordered products:
If the products ordered prove unavailable for delivery, MADAME LA PRESIDENTE immediately informs the Customer and offers an extension of the initial delivery time or a product of equivalent quality and price. In the event of refusal by the Customer, MADAME LA PRESIDENT immediately cancels the order and reimburses without delay the sums paid by the Customer.
6.5 Modification or cancellation of the order:
For logistical reasons, order modifications and cancellations are not possible once the order has been validated and paid for by the Customer. If a request is made by the Customer by email or by after-sales service form, Madam President will request a return of the package to the carrier. The return of the package will systematically result in the deduction of the costs incurred by Madam President for the preparation of the order and the delivery and return of the package from the reimbursement.
The contract will be, in application of the provisions of the Civil Code, concluded from the second click of the order, by which you will have confirmed your shopping cart after having been able to correct it.

8.1 The Subscription to the Madame la Présidente service is monthly (every month) or quarterly (every three months). Subscribing to the Monthly or Quarterly Subscription subscribes the subscriber to the Madame la Présidente product shipping service for a minimum of three shipments and until one party decides to terminate this contract. By accepting this offer, the Subscriber agrees to a monthly or quarterly debit of an amount defined during the initial order. Thus, as long as the Subscription continues, the Subscriber's renewal will be debited every month for a monthly subscription (twenty-five (25) days after the initial Order and then every thirty (30) days after this first debit for subsequent renewals), and every three (3) months for a quarterly subscription (every eighty-five (85) days after the initial Order). These dates can be modified by the Subscriber with Madame la Présidente customer service or directly in the “My account” area.
The Subscriber's order will be processed within 48 hours from the order date. Delivery time depends on the carrier and delivery location.
Any modification request made in the “My Account” area can only be taken into account within 48 hours. If a shipment has already been made or a withdrawal made during these 48 hours, the shipment or withdrawal will not take this request into account.
The Subscriber may terminate his Subscription according to the terms of commitment provided for in the “Unsubscription” article of the General Conditions of Sale.
By subscribing, the Subscriber declares having read the General Conditions of Sale, having understood them and accepting them without reservation, with full knowledge of the facts.
Under Article L. 241-3 of the Consumer Code, when the professional has not made the reimbursement under the conditions provided for in Article L. 215-1 of the Consumer Code, the amounts due are subject to interest at the legal rate.
The use of one-off promotional codes on the madamelapresidente.fr website does not provide any possibility of a reduction on the subscription.
The information allowing the Subscriber to identify himself, such as the username and password, is personal and confidential. This information may only be modified on the initiative of the Subscriber or the Company, in particular in the event of forgetting the password. The Subscriber is solely responsible for the use of his identification details. He is required to keep them secret. Any disclosure on his part may in no case be blamed on the Company. Any Order made using the Subscriber's username and password is deemed to have been placed by the latter. The Seller may in no case be held liable for damages caused by the disclosure of this personal and confidential data by the Subscriber and therefore the use of this data by a third party. The Company may not, in any event, be held liable for any damage of any nature whatsoever, in particular due to the use of the subscribed services, whether it be damage to reputation, image, or loss of data which could occur due to the use of the services offered by the Company.

For any subscription, the subscriber is subject to a commitment of three (3) minimum shipments. The Subscriber may terminate his Subscription only at the end of this period, in his “my account” space on the Site.
If the termination occurs after the automatic debit made for the month, the Order is deemed to have been concluded for the month concerned. The Subscriber may not demand the cancellation of this Order by arguing his request for termination. The unsubscription is taken into account for the following month.
Unsubscription may also result from the Company's decision following the terms set out in Article 11 “deactivation of customer account” hereof.
In the event of unsubscription, a Customer, benefiting from a Subscription at a lower price due to his seniority, will lose this privilege and will have to pay the rate in force if he wishes to resubscribe.
In the event of a request for cancellation of the contract before the three-month period, the amount of the difference between the orders placed with a subscription and the amount that the customer would have paid without a subscription will be requested as compensation for termination of contract.
If a shipment has been made and is returned, this amount, plus shipping costs, will be withheld from refunds.

9.1 Delivery time and costs:
For any finalized order and subject to the proper receipt of the Customer's payment, MADAME LA PRESIDENTE undertakes to ship the products ordered within 48 hours at the latest. If the description sheet of a product indicates a specific delivery time, it is the latter that will bind MADAME LA PRESIDENTE. By default and in any event, subject to the proper receipt of the Customer's payment, MADAME LA PRESIDENTE undertakes to deliver the products ordered within thirty (30) days following the validation of the order.
If a product is unavailable for delivery, point 6.4 of these terms will apply.
- For deliveries in mainland France, the cost of Colissimo home delivery is €5.90 including tax. The cost of sending to a relay point is €3.90. Sending to a relay point is fully covered by MADAME LA PRESIDENTE if the order is for an amount greater than €50 including tax (excluding delivery costs). For overseas territories, the cost of Colissimo home delivery is €14.90 including tax.
- To find out the delivery costs outside French territories, the customer will be informed before confirming their basket.
9.2 Customs charges
Please note that in addition to the price of the treatments and the delivery costs of your order, your country of residence may require you to pay customs and import fees. For more information, please contact your local customs office and inquire about the applicable duties and taxes before placing your order. These taxes and customs fees are not our responsibility and we are not liable for them. If you refuse to pay these taxes or are unable to collect your order and it is returned to us, we will require you to pay all costs incurred.
9.3 Delay in delivery:
Any delay in delivery exceeding thirty days and not due to a case of force majeure may result in the cancellation of the sale by the Customer who, within sixty working days from the indicated delivery date, cancels his order by registered letter with acknowledgement of receipt, returns the products if they have been delivered and receives from MADAME LA PRESIDENTE no later than thirty days the refund of his payment, excluding any compensation.
Exceeding delivery times cannot give rise to damages or deductions, nor to cancellation by the purchaser of current orders. In any event, delivery on time can only occur if the purchaser is up to date with its obligations towards MADAME LA PRESIDENTE, whatever the cause.
9.4 Delivery terms:
The products are delivered by post or by independent carrier, depending on the nature of the product and the destination, at the exclusive initiative of MADAME LA PRESIDENTE, to the address indicated by the Customer on the order form. Any claim for delivery errors must be made by the Customer to MADAME LA PRESIDENTE on the same day of delivery or the first working day following delivery at the latest. In the event of an error in the delivery address attributable to the Customer, the return and reshipping costs will be re-invoiced by MADAME LA PRESIDENTE. A delivery note must be signed by the Customer who must check the conformity and condition of the packaging of the product upon receipt.
Deliveries are made according to availability and in the order of orders. The company MADAME LA PRESIDENTE is authorized to make deliveries in full or in part. Delivery times are indicated as accurately as possible but are based on supply or production possibilities, or even the possibilities of the carrier.
In the event of deterioration or partial loss of the product, the Customer must imperatively formulate reservations on the delivery note upon receipt, a copy of which is sent to MADAME LA PRESIDENTE and, within three days of this receipt, notify these reservations to the carrier by registered letter with acknowledgement of receipt in accordance with Article L. 133-3 of the French Commercial Code.
9.5 Product conformity:
If the product does not comply with the order, the Customer must send, within a reasonable time after receipt, a complaint to MADAME LA PRESIDENTE with a view to obtaining the replacement of the product or possibly the resolution of the sale.
9.6 Unavailability of products:
In the event of unavailability of products upon delivery, MADAME LA PRESIDENTE may offer, under the conditions set out in article 6-4 of the General Terms and Conditions, an extension of the initial delivery time or a product of equivalent quality and price.
9.7 Failure to deliver:
Total failure to deliver shall result in the automatic termination of the sales contract.
